Please read these Terms of Service (“Terms”) carefully before using TreeServiceNation.com (the “Site”) operated by TreeServiceNation (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. What TreeServiceNation Is

TreeServiceNation is a free referral service that connects homeowners with independent, licensed tree service contractors. We do not perform tree removal, trimming, stump grinding, or any other tree service ourselves.

When you submit a quote request, your information is shared with up to 3 independent contractors in your area who may contact you with pricing and availability. We facilitate the introduction — the service agreement, pricing, and work are entirely between you and the contractor you choose to hire.

2. We Are Not a Contractor

TreeServiceNation is not a licensed contractor, does not hold any contractor's license, and does not perform any tree services. We are solely a marketing and lead referral platform.

Any quotes, estimates, scheduling, work agreements, invoices, or disputes are solely between you and the independent contractor. TreeServiceNation is not a party to any agreement between you and a contractor and bears no responsibility for any work performed or not performed.

3. User Eligibility

To use this Site, you must:

• ·Be at least 18 years of age
• ·Be a resident of the United States
• ·Have the legal authority to request tree services for the property you identify
• ·Provide accurate, current, and complete information in your quote request

By using the Site, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service to anyone at any time.

4. TCPA Consent & Telephone Contact

By submitting a quote request on this Site, you expressly consent — pursuant to the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable state laws — to receive telephone calls, text messages (SMS/MMS), and other communications from TreeServiceNation and from the independent contractors in our network at the phone number you provide.

These communications may be initiated using an automatic telephone dialing system (ATDS) or an artificial or prerecorded voice message. Standard message and data rates from your carrier may apply.

Your consent is not a condition of purchase or service. You may revoke consent at any time by replying STOP to any text message or by emailing us at contact@treeservicenation.com. Opting out will prevent future contacts from us but may not stop contacts from contractors who received your information prior to opt-out.

5. Independent Contractors

All tree service providers accessible through our platform are independent businesses. They are not employees, agents, partners, joint venturers, or franchisees of TreeServiceNation.

TreeServiceNation does not supervise, direct, or control the work of any contractor. We do not set contractor pricing, guarantee contractor availability, or warranty the quality, safety, timeliness, or legality of any services performed. You are solely responsible for vetting and hiring any contractor you choose to engage.

6. No Guarantee of Quality or Availability

TreeServiceNation makes no representation or warranty that:

• ·Any contractor will be available in your area or will respond to your request
• ·Any contractor is properly licensed, insured, or bonded in your jurisdiction
• ·Any contractor's work will meet your expectations or comply with applicable laws
• ·Quotes provided by contractors will be accurate, final, or competitive
• ·The Site will be available or error-free at all times

Always independently verify a contractor's license, insurance, and references before authorizing any work on your property.

7. Limitation of Liability

To the fullest extent permitted by applicable law, TreeServiceNation and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• ·Property damage caused by a contractor
• ·Personal injury arising from a contractor's work
• ·Financial loss resulting from a contractor's services or failure to perform
• ·Any claims arising from your reliance on information provided through the Site

In no event shall our total liability to you exceed $100. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.

8. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association (AAA), rather than in court.

You waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration. If arbitration is found unenforceable, disputes shall be resolved exclusively in the state or federal courts located in California.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in California for any disputes not subject to arbitration.

10. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised “Last updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
